1. Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and the operators of Smart Wallet (“we,” “us,” or “our”) regarding your access to and use of:
- This marketing website; and
- The Smart Wallet Chrome extension (the “Extension”), including related documentation and product features.
By accessing the site, installing the Extension, or using Smart Wallet, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site or Extension.
2. Eligibility
You must be of the age of majority where you live (or have valid parental/guardian consent where the law allows) and have the legal capacity to enter into these Terms. You may not use Smart Wallet if applicable law prohibits you from doing so.
3. License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Extension and to access this website for lawful purposes.
You may not (except to the extent applicable law expressly allows and cannot be waived): reverse engineer, decompile, or attempt to extract source code beyond legally permitted interoperability; remove proprietary notices; or scrape, crawl, or overload the site or our infrastructure in an abusive way.
4. Description of Smart Wallet
Smart Wallet is a non-custodial, multi-chain browser extension wallet. You control your keys. We do not hold your funds in a custodial account. Software wallet material is intended to remain encrypted on your device; hardware wallet keys (for example Ledger, where supported) remain on the device.
Features may include sending and receiving assets, connecting to dApps, and in-wallet swap or bridge routing through third-party providers. 5. No custody / no recovery guarantee
Because Smart Wallet is non-custodial, if you lose your seed phrase, private keys, password, or device access, we cannot recover your funds or reset access for you. There is no “forgot password” path that restores custody of keys we never held. Keep offline backups of your recovery phrase and protect them carefully.
Never send seed phrases or private keys to support. We will never ask for them.
6. Your responsibilities
You agree to:
- Safeguard your recovery phrase, keys, and device;
- Verify you are using official URLs and the official Chrome Web Store listing before installing or entering secrets;
- Review transaction details, permissions, and signature requests carefully before approving;
- Understand that networks charge fees, that swaps and bridges involve slippage and smart-contract risk, and that blockchain transactions are often irreversible;
- Comply with all laws that apply to you, including sanctions and tax obligations; and
- Use Smart Wallet only for lawful purposes.
7. Prohibited uses
You may not use Smart Wallet or the site to:
- Engage in illegal activity, fraud, money laundering, or sanctions evasion;
- Distribute malware or attempt to hack, disrupt, or overload our systems or users;
- Impersonate Smart Wallet, phishing users, or distributing fake wallets, fake extensions, or deceptive sites;
- Harvest data from the site in ways that violate these Terms or applicable law; or
- Interfere with others’ use of the product.
8. Third-party services
Smart Wallet may interact with third-party services you choose to use, including RPC providers, bridges, swap aggregators, dApps, Ledger or other hardware, Chrome/Google, and Cloudflare or similar infrastructure. Those services have separate terms and privacy policies. We do not control them.
Outages, delayed transactions, failed quotes, slippage, smart-contract bugs, oracle issues, or other third-party failures can occur. You accept those risks when you use those features.
9. Fees
You are responsible for:
- Network fees charged by blockchains;
- Protocol or aggregator fees charged by third-party swap/bridge providers; and
- Smart Wallet service fees, if any, on certain swaps or bridges as disclosed in-product at the time of the transaction.
Fee amounts and when they apply can change. Always review the amounts shown before confirming.
10. No financial, investment, legal, or tax advice
Nothing on the site or in the Extension is financial, investment, legal, or tax advice. Cryptocurrency and digital assets are volatile and risky. You may lose value, including a total loss. You alone decide whether and how to use Smart Wallet and related networks. Seek professional advice if you need it.
11. Intellectual property
Smart Wallet name, marks, logos, website content, and related branding are owned by the operators of Smart Wallet or their licensors. These Terms do not transfer ownership of that intellectual property to you. You may not use our marks in a way that confuses users or suggests sponsorship without permission, except for truthful references to the product.
12. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND SMART WALLET ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCT WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA WILL BE SECURE OR NOT LOST.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above disclaimers and limitations may not apply to you.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATORS OF SMART WALLET AND THEIR CONTRIBUTORS, AFFILIATES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST KEYS, LOST FUNDS, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR EXTENSION, EVEN IF ADVISED OF THE POSSIBILITY.
WITHOUT LIMITING THE FOREGOING, WE HAVE NO LIABILITY FOR: loss of seed phrases or private keys; loss of funds due to user error, phishing, malware, or compromised devices; third-party RPC, swap, bridge, dApp, or hardware failures; smart-contract risk; or network congestion or forks.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed.
14. Your statutory rights
Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under applicable consumer protection law that cannot lawfully be excluded, restricted, or modified by agreement.
If you use Smart Wallet as a consumer, some of the disclaimers, exclusions, and limitations of liability in these Terms may not apply to you, or may apply only to the extent permitted by the laws of the place where you live. In that case, those provisions apply only as far as the law allows, and your non-waivable rights remain unaffected.
15. Indemnity
You agree to defend, indemnify, and hold harmless the operators of Smart Wallet and their contributors and providers from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the product, your violation of these Terms, your violation of law, or your infringement of others’ rights.
16. Suspension, termination, and changes
We may suspend or terminate access to the site, Extension updates, or related services if you violate these Terms, if required by law, or to protect the product or users. You may stop using Smart Wallet at any time by uninstalling the Extension and discontinuing use of the site.
We may change, suspend, or discontinue features of the site or Extension. We may also update these Terms. When we update Terms, we will revise the “last updated” date on this page. Continued use after changes constitutes acceptance to the extent permitted by law. If you do not agree to updated Terms, stop using the site and Extension.
17. Governing law and disputes
These Terms and any dispute arising out of them are governed by applicable law. We have not designated a specific state or country jurisdiction on this page. If a formal legal entity and governing-law jurisdiction are designated later, that designation will be stated in an updated version of these Terms. Until then, disputes will be handled under the laws that properly apply, and nothing in this section waives mandatory consumer protections that cannot be disclaimed.
18. Severability, entire agreement, no waiver
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms will continue in full force and effect. These Terms, together with the Privacy Policy and any in-product disclosures that expressly form part of the agreement (such as fee displays), are the entire agreement between you and us regarding the site and Extension, and supersede prior conflicting understandings on that subject. Our failure to enforce a provision is not a waiver of our right to enforce it later.
